Matthew Kennedy opened the meeting at 7:00 p.m.  

7:00 p.m        NOTICE OF INTENT – Mt. View Middle School – 270 Shrewsbury Street – Town of Holden  Conservation Commission member Luke Boucher was able to participate in the hearing under the Mullins Rule by reviewing minutes form the October 2, 2013 hearing.   Michael Andrade, Graves Engineering discussed results of the downstream analysis requested by the Commission at the October 2, 2013 meeting.   Revised plans and data resulting from the downstream analysis were distributed to the Commission.  The Department of Environmental Protection removed the Zone A tributary area that incorrectly mapped the stormwater outlet.  The analysis identified three downstream 18” culverts which limited flow under current conditions, this resulted in increasing the capacity of the detention pond.   

The bordering vegetated wetland located at the proposed driveway entrance was added to the plan, and the replication area was located beside the driveway.  The Applicant requested a waiver for the 25’ no disturb zone required in the local regulations.  

The revised basin is 6.5 feet deep. Native material will be utilized on the slope of the berm to create uniform infiltration.   Depth of water at the 100 year storm event was 5.5’.   The rates and durations were compared at the 3 limiting 18” culverts and the peaks did not increase.   There is 1’ of free board with no flow in spillway.  The spillway was relocated so it is in a shallower area of fill, Matthew Kennedy requested it be moved further, he stated the spillway should be embanked into the slope.  The Cornell rainfall data resulted in an almost 2” increase for the 100 year storm.  


Rocky D’Angelo, 45 Ottoson Way was concern about water from the parking area being directed to new locations by the change in grading.  It was explained to him that water from the parking lot will be directed into the detention pond and not over the slope of the parking area.     Mr. D’Angelo questioned where runoff from snow plowing would be directed, it would likely be plowed over the back edge of the parking area.    Kenneth Lipka,   Ottoson Way asked what the increase of runoff of the site would be, the results of the downstream analysis were explained.  

MaryAnn Cataldo, 22 Ottoson Way, stated there was a stream behind and beside her and her yard currently floods, she stated that she does not want anymore water on her property from this development.  Matthew Kennedy explained that is why the Commission asked for additional information regarding peak and duration of stormwater.

Susan D’Angelo, 45 Ottoson Way wants to know what will prevent the parking lot area from settling overtime, she was informed various compaction testing will be conducted during construction.  She asked how the surface water does not get affected by the removal of trees and was informed this was accounted for in the stormwater calculations.  She asked what her recourse was to ensure her property is not affected.  Matthew Kennedy informed her we were reviewing all the calculations but it cannot be guaranteed.  

The 25 year storm would overflow the berm of the parking lot, Matthew Kennedy asked what were the results of a 6.5” per hour storm.  The hearing was continued to December 4, 2013.  

ABBREVIATED NOTICE OF RESOURCE AREA DELINEATION – C.B. Blair Development Greenwood Estates – Union Street  EcoTec, Inc was hired to conduct peer review of the resource areas.  The site walk was conducted on November 5, 2013 and the report has not been completed.  The item was continued to the December 4, 2013 meeting.   

AMENDMENT TO NOTICE OF INTENT – Quinapoxet Street-temporary gravel operation Jefferson Meadows, LLC DEP File # 183-547 – The applicant has submitted an amendment to the current Order of Conditions to allow for widening of the culvert from 14’ to 24’ in width, this proposal includes the demolition of an existing retaining wall, temporary stream diversion and fill of additional bordering vegetated wetlands. The area of fill was increased from the approved 963 square feet to 1,548 square feet, the increase to over 1,000 square feet of fill has required the filing of an Environmental Notification Form.  The future use of the property has not been determined.  The Applicant was encouraged to continue the public hearing to December 4, 2013 pending any amendments to the Water Quality Certification Permit.   

REQUEST FOR DETERMINATION OF APPLICABILITY Maple Spring Pond Dam Maintenance – City of Worcester –Matt Dufresne from the City of Worcester Water Department has submitted an RDA to remove trees from the maple spring pond earthen dam located on Princeton Street.  Four trees, including the root systems, will be removed, erosion control will consist of wattles.  The Conservation Commission was concerned about the proximity of the trees to the Princeton Street pavement and requested the City notify the Holden Department of Public Works prior to the start of work.  Mr. Dufresne stated that structural fill will be utilized to fill in voids left by the stump removal.  Luke Boucher made a motion to issue a Negative Determination with no conditions, Michael Krikonis seconded the motion, all were in favor, 6-0.  

NOTICE OF INTENT – Construction of Single Family Home – 100 High Street – Edward Holden –Norman Hill, Land Planning Inc. presented the plan, the applicant is proposing to construct a single family home and restore a pond.  The pond is utilized for agricultural purposes.  The driveway is the only portion of the home which will be located within the buffer zone of the bordering vegetated wetlands.  A revised plan with a driveway located within the existing cart path was presented, the Commission agreed to the revised layout with the condition the curve in closest proximity to the Bordering Vegetated Wetlands by rounded out and moved 20’ from the wetlands, the Applicant agreed.  The Commission considered dredging the watering hole as restoration work and will require excavation in the Summer.  Kenneth Strom made a motion to close the public hearing, Anthony Costello seconded the motion, all were in favor, 6-0.  Kenneth Strom made a motion to issue a standard Order of Conditions with special condition the driveway be relocated by softening the curve with approximately 20’ to the wetland line, that the water hole restoration be conducted between July 1 to September 1 during dry months and that top soil from the excavation be utilized to stabilize the excavation.  Michael Krikonis seconded the motion, all were in favor, 6-0.

CERTIFICATE OF COMPLIANCE – 482 Reservoir Street  – 183-421 Single Family Home – Bergeron – This Order was issued for grading associated with the construction of a single family home.  The Order expired in 2007, the work was complete in accordance with the approved plans.  Michael Krikonis made a motion to issue a Certificate of Compliance, Kenneth Strom seconded the motion, all were in favor, 6-0.  

CERTIFICATE OF COMPLIANCE – 30 Cimarron Lane (Lot E) DEP File #183-366 B.A. Sundin & Son, Inc.  Previously denied, no new information submitted.

CERTIFICATE OF COMPLIANCE – 40 Sheffield Way DEP File #183-516 Hadley Construction of Single Family Home Previously denied no additional information submitted.  

CERTIFICATE OF COMPLIANCE – 64 Holt Road DEP File #183-308 Site Work  - This Order was for yard expansion associated with a single family home, the Order expired in 2003.  The work was completed according to plans and all areas are have been stabilized for a significant period of time.  Luke Boucher made a motion to issue a Certificate of Compliance, Anthony Costello seconded the motion, all were in favor, motion passed 6-0.

Kenneth Strom made a motion to approve the minutes form October 4, 2013, Michael Krikonis seconded the motion, Luke Boucher abstained, motion passed 5-0.

The Commission asked about the possibility of utilizing funds collected under the Wetlands Protection Act to hire a consultant to review outstanding expired Orders of Conditions, the Agent will investigate if it is an acceptable use of funds.

Michael Krikonis made a motion to adjourn, Anthony Costello seconded the motion, all were in favor, 6-0.

The next meeting will be conducted on December 4, 2013

The November 6, 2013 meeting minutes were approved on December 4, 2013.
